Sea Breathe warrants that for a period of 3 years (Deck Units) 1 year (Float Units) from date of shipment from Sea Breathe, the equipment, product(s) and part(s) (collectively referred to herein as "Product") will be, under normal use, free from defects in material and workmanship provided, however, that this warranty does not cover, and Sea Breathe shall not be liable for, any malfunction, damage or wear caused by faulty installation, misapplication, abrasion, inadequate or improper maintenance, negligence, accident, tampering, substitution of non-Sea Breathe component(s) part(s) or product(s), improper storage, or other misuse. All warranty claims must be made in accordance with "Warranty Claims" below.
Sea Breathe agrees to assign to Customer whatever rights Sea Breathe may have under any warranty, expressed or implied, of any supplier or manufacturer of product(s) sold by Sea Breathe but not manufactured by Sea Breathe, to the extent assignable.
Sea Breathe's entire liability and Customer's exclusive remedy under this warranty will be to repair, or at Sea Breathe's option, to replace without charge, any product(s) which Sea Breathe determines to be defective within the scope of this warranty. In the event Sea Breathe is unable to repair or replace defective product(s) within a reasonable time after receipt, Sea Breathe shall credit Customer with the original purchase price of the defective product(s).
THE FOREGOING WARRANTY IS IN LIEU OF ANY OTHER WARRANTY, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
To make a warranty claim, Customer must comply with the procedures stated herein, which are designed to protect both the Customer and Sea Breathe. Customer must call a Sea Breathe representative to place warranty claim. Equipment, part(s) or product(s) returned for warranty without proper authorization will be returned to Customer at the Customers expense.
Upon calling Sea Breathe, a representative will determine whether Customer should ship the equipment, part(s) or product(s) to Sea Breathe. Upon receiving the item(s), Sea Breathe will perform a inspection of the equipment, part(s) or product(s) and will determine whether there is a defect covered by warranty. If there is a defect covered by warranty, Sea Breathe will pay for all shipping of the return and/or replacement. If Sea Breathe determines that the equipment, part(s) or product(s) are not covered under the warranty, Customer will be responsible for all shipping charges. (Free shipping for manufacturing warranty claims only in North America.)
